These Terms of Service ("Terms") govern access to and use of Mapzio (the "Service"), operated by Mousewerk, Maurice Kleindienst, Weserstraße 16 A, 34125 Kassel, Germany ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you are agreeing on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization as well as you individually.
Mapzio lets teams draw and collaborate on event site layouts over satellite imagery, invite collaborators, export site plans, and manage billing for their organization. Features, limits, and pricing vary by plan (Free, Team, Business) as described in the app at the time of purchase and may change with notice for future billing periods.
You must provide accurate information when registering and keep your login credentials confidential. You're responsible for all activity under your account. Tell us promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
An organization's owners and admins can invite and remove members, and can access events and content created within that organization. Content you create within an organization (site plans, elements, comments, uploaded exports) is owned by you and/or your organization as you determine internally, but you grant the other members your organization's roles permit to view, edit, or export it, consistent with the permissions you assign. We are not a party to, and do not adjudicate, disputes between members of the same organization over ownership of content.
The Service lets an event owner generate a public, unauthenticated link that shows a read-only view of that event. Anyone with that link can view it - do not enable or share a public link for anything you don't want visible to anyone who obtains the URL.
Paid plans are billed in advance on a recurring basis (monthly or annual) through our payment processor, Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel. You can manage or cancel your subscription at any time from your organization's billing page. Fees are non-refundable except where required by law - including the statutory right of withdrawal described in Section 6 for consumers. If a payment fails, we may downgrade your organization to the Free plan after a reasonable retry period.
If you are a consumer within the meaning of § 13 BGB (i.e. acting for purposes outside your trade, business, craft, or profession), German and EU law gives you a 14-day right to withdraw from a paid subscription. Businesses acting in a commercial or professional capacity do not have this statutory right, though we generally try to work with you in good faith regardless.
When you start a paid plan, we ask you to separately confirm that you want the Service to begin immediately, and that you understand this ends your right of withdrawal once we have fully provided the service you paid for (Art. 246a § 1 Abs. 3 EGBGB, § 356 Abs. 5 BGB) - because the Service is delivered continuously, "fully provided" in practice means the withdrawal right otherwise lapses at the end of the current billing period you already paid for. The statutory notice below sets out your rights in full.
Widerrufsrecht
Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsabschlusses.

mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief oder eine E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das Muster-Widerrufsformular unten verwenden, das jedoch nicht vorgeschrieben ist.
Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.
Folgen des Widerrufs
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.
Haben Sie verlangt, dass die Dienstleistungen während der Widerrufsfrist beginnen sollen, so haben Sie uns einen angemessenen Betrag zu bezahlen, der dem Anteil der bis zu dem Zeitpunkt, zu dem Sie uns von der Ausübung des Widerrufsrechts hinsichtlich dieses Vertrags unterrichten, bereits erbrachten Dienstleistungen im Vergleich zum Gesamtumfang der im Vertrag vorgesehenen Dienstleistungen entspricht.
Besonderer Hinweis
Ihr Widerrufsrecht erlischt vorzeitig, wenn wir die Dienstleistung vollständig erbracht haben und mit der Ausführung der Dienstleistung erst begonnen haben, nachdem Sie dazu Ihre ausdrückliche Zustimmung gegeben haben und gleichzeitig Ihre Kenntnis davon bestätigt haben, dass Sie Ihr Widerrufsrecht bei vollständiger Vertragserfüllung durch uns verlieren.

You agree not to:
We aim to keep the Service available and reliable but don't guarantee uninterrupted access. We may modify or discontinue features with reasonable notice where practical.
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate access for violation of these Terms. On deletion, your data is removed as described in our Privacy Policy.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim. Nothing in these Terms limits liability for intent, gross negligence, injury to life, body, or health, or any other liability that cannot be limited under German law.
We may update these Terms from time to time. We'll update the "Last updated" date above; continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Germany, excluding its conflict-of-law rules. If you are a consumer, this choice of law does not deprive you of protections you're entitled to under the mandatory law of your country of residence.
